1. Who we are
SparkCheck is operated by Simply Sorted, LLC("Simply Sorted"). Simply Sorted, LLC is the data controller for personal data processed through the Service.
2. Information we collect
- Account data: name, work email, hashed password.
- Company data: company name, team membership, role (admin/employee), invite records.
- Check-in data: daily numeric ratings for mood, energy, stress, and sleep, plus an optional private note.
- Usage and technical data: IP address, device and browser type, log data, and basic product analytics.
- Support communications: messages you send us.
Payment card data is collected directly by Paddle, our Merchant of Record. We do not store full card numbers.
3. How we use it
- To create and operate your account and team workspace.
- To provide the check-in feature and generate anonymized team trends.
- To prevent fraud, abuse, and security incidents.
- To improve the Service and fix bugs.
- To respond to support requests.
- To send essential service emails (e.g. invites, billing receipts).
4. Anonymization for managers
Individual check-in answers are never shown to managers or employers. Team dashboards display aggregated averages only, and trends are only shown once a team has at least 3 participating members.
5. Legal basis
We process your data on the basis of (a) performance of our contract with you (to provide the Service), (b) our legitimate interests in running and securing our business, (c) consent where required, and (d) compliance with legal obligations.
6. Who we share data with
- Service providers / subprocessors: cloud hosting and database providers, email delivery, and analytics tools that help us run the Service.
- Paddle (Merchant of Record): for sales of the product, subscription management, payments, tax compliance, and invoicing.
- Professional advisers: legal, accounting, and similar advisers under confidentiality.
- Authorities: where required by law, regulation, or valid legal process.
We do not sell your personal data.
7. Data retention
We keep personal data only as long as needed to provide the Service or to comply with legal obligations. When you delete your account, we delete or anonymize associated personal data within a reasonable period, except where retention is required by law (e.g. tax records).
8. Your rights
Depending on where you live, you may have the right to access, correct, delete, or export your personal data, and to object to or restrict certain processing. To exercise these rights, email simplysorted@myyahoo.com. EEA/UK users have the right to lodge a complaint with their local data protection authority.
9. Security
We use appropriate technical and organisational measures to protect personal data, including encryption in transit, access controls, and row-level security on our database. No system is 100% secure, but we work to continuously improve our safeguards.
10. International transfers
Personal data may be processed in the United States and other countries where our providers operate. Where required, we rely on appropriate safeguards such as standard contractual clauses.
11. Cookies
We use strictly necessary cookies to keep you signed in and to operate the Service. We may use limited analytics cookies to understand aggregate usage. You can manage cookies via your browser settings.
